  1. Hello Counsel. It's a pleasure finding this forum. Wish we could get much from this.

  2. Members debate cigarette plain-packaging’s impact on trademark rights

A new Australian draft law that would require cigarettes — and eventually other tobacco products — to be sold in plain packages, came under scrutiny in the 7 June 2011 WTO intellectual property (TRIPS) council meeting. Some members said it could violate trademark rights while others defended it as a legitimate step to protect public health.

  3. Plain packaging will encourage "illegal goods producers" (illicit trade)to produce contraband cigarettes but this all the same will not have any major impact on "big time" cigarette smokers. They will be consuming the same product of proabably lower quality which might be more harmful to their health. I know this is good news to them who like 'imitation'(419) Naijas...and Chintoks!!! take note! Plain packgaging = More confustion, more counterfeit and more danger to cigarette smokers!

  4. Well, it's certain this plain packaging will encourage "illegal goods producers" to take advantage and co-produce with the legitimate manufacturers. Nonetheless, the responsibility it is for this manufacturers to orientate their clients on the other anti-counterfeit signs which are not necessarily the company logo or slogan.

  5. hi cindy, thanks for your comment, true plain packaging may encourage illegal smokers and promote 'illegal goods producers'from smoking
but dont you think the fact that cigarettes packages will now be palin may also dicourage some smokers as there may be smokers who'll not go for anything in a plain package to smoke,
also dont you think this may also discourage 'illegal goods producers'as they may not know what exactly to copy and put in the maeket which will be fake?
